Apportionment - Higham Park - 1839


Apportionment of the Rent Charge in lieu of Tithes in the Extraparochial District or place, pieces or parcels of inclosed Land called Higham Park in the County of Northampton.

Whereas an Agreement for the commutation of the Tithes in the Extraparochial District of Higham Park in the County of Northampton was on the thirty first day of January in the year one thousand eight hundred and thirty nine confirmed by the Tithe Commissioners for England and Wales of which Agreement with the Schedule thereunto annexed the following is a copy.

Articles of Agreement for the Commutation of the Tithes of the Extraparochial District or place called Higham Park in the County of Northampton in pursuance of the Act for the Comumutation of Tithes for England and Wales made and executed at a Meeting duly called and holden in the said Extraparochial District on Monday the twentieth day of August in the year of our Lord one thousand eight hundred and thirty eight by and between Thomas Strother of Leeds in the County of York Gentleman Sole owner of Land within the said Extraparochial District by whom or by whose Agent duly authorized in that behalf these presents are executed of the one part and the said Thomas Strother Owner of all the Tithes as well great as small of the said Extraparochial District of the other part. It is hereby agreed that the Annual sum of One hundred and twenty Pounds by way of Rent charge (subject to the provisions of the said Act) shall be paid to the said Thomas Strother and to his heirs and Assigns instead of all the Tithes as well great as small of the lands of the said Extraparochial District  subject to Tithes and instead of all Moduses and compositions real and prescriptive and customary, payments payable in respect of all the Lands of the said Extraparochial District or the produce thereof a summary description of which Lands is contained in the Schedule hereunto annexed And it is further agreed that the Lands included in the Agreement shall be discharged from the payment of Tithes from the first day of April following the confirmation of the apportionment of the Rent charge hereinbefore agreed on and that the first payment of such Rent charge shall be made or be recoverable on the Expiration of six Calendar Months from the time from which the said Lands are discharged from the payment of Tithes In Testimony whereof the said Thomas Strother as Tithe owner and also as Land Owner to these presents by his Agent thereunto duly authorized in his name and on his behalf hath to these Presents subscribed and set his hand and Seal.

Schedule to the above Articles of Agreement

The whole Extraparochial District of Higham Park aforesaid contains Five hundred and ninety six Acres three Roods and nine Perches of Land Statute measure and the whole of which is subject to the payment of all manner of Tithes as well great as small.

The whole quantity of Land subject to Tithes within the said Extraparochial District which is cultivated as arable Land is four hundred and sixty four Acres three Roods and thirteen Perches statute measure.

The whole quantity of Land subject to Tithes within the said Extraparochial District cultivated as Meadow or pasture Land is one hundred and thirty one acres three Roods and thirty six perches Statute measure.

Now I Joseph Dearlove of Higham Park in the County of Northampton Farmer having been duly appointed valuer to apportion the Total sum agreed to be paid way of Rent charge in lieu of Tithes amongst the several Lands of the said Extraparochial District of Higham Park Do hereby apportion the rent charge as follows

Gross Rent Charge payable to the Tithe Owner in lieu of Tithes for the Extraparochial District or place, pieces or parcels of inclosed Land called Higham Park in the County of Northampton One hundred and Twenty Pounds.

Value in Imperial Bushels and Decimal parts of an Imperial Bushel of Wheat Barley and Oats viz.
